You represent that You are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of Our Privacy Policy, which describes how We collect, use and disclose Your personal information. Please read it carefully before using Our Service.

3. Australian Consumer Rights

Nothing in these Terms and Conditions is intended to limit or exclude any rights You have under Australian law, including under the Australian Consumer Law (ACL), which is Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Under the Australian Consumer Law, Goods sold to consumers come with automatic Consumer Guarantees that cannot be excluded. These include guarantees that Goods will be of acceptable quality, fit for a disclosed purpose, match their description, and that the Company has the right to sell them.

If Goods fail to meet a Consumer Guarantee, You may be entitled to a remedy. For a major failure, You may choose a refund, replacement, or compensation for the difference in value. For a minor failure, We may choose to repair, replace, or refund the Goods.

If You are acquiring Goods for the purposes of a business, the Consumer Guarantees under the Australian Consumer Law may not apply to those Goods.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

4. Placing Orders for Goods

By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.

Your Information

If You wish to place an Order, You may be asked to supply certain information relevant to Your Order, including Your name, email, phone number, payment details, billing address, and shipping information.

You represent and warrant that: (i) You have the legal right to use any payment method in connection with any Order; and (ii) the information You supply to Us is true, correct, and complete.

By submitting such information, You grant Us the right to provide the information to payment processing third parties for the purpose of completing Your Order.

Order Cancellation by the Company

We reserve the right to refuse or cancel Your Order at any time for certain reasons, including but not limited to:

  • Goods availability
  • Errors in the description or prices for Goods
  • Errors in Your Order
  • Suspected fraud or an unauthorised or illegal transaction

Your Order Cancellation and Return Rights

Any Goods You purchase can only be returned in accordance with these Terms and Our Returns Policy, and subject to Your rights under the Australian Consumer Law.

For change-of-mind returns, Your right to return Goods only applies to items returned in the same condition as You received them, with all product instructions, documents, and original packaging included. Goods that are damaged or worn beyond opening the original packaging will not be refunded unless there is a fault covered by the Australian Consumer Law.

For faulty or misdescribed Goods, Your rights under the Australian Consumer Law apply regardless of whether the product has been opened or used.

You will not have the right to a change-of-mind return for:

  • Goods made to Your specifications or clearly personalised.
  • Goods that by their nature are not suitable for return, deteriorate rapidly, or have expired.
  • Goods not suitable for return due to health protection or hygiene reasons and which were unsealed after delivery.
  • Goods which, after delivery, have been inseparably mixed with other items.

Availability, Errors and Inaccuracies

We are constantly updating our Goods on the Service. Goods may occasionally be mispriced, described inaccurately, or unavailable. We reserve the right to correct errors, inaccuracies, or omissions at any time. Where a pricing error has occurred, We will notify You and You will have the right to cancel Your Order.

Prices

All prices displayed on the Service are in Australian dollars (AUD) and, where applicable, include Goods and Services Tax (GST) as required under the A New Tax System (Goods and Services Tax) Act 1999 (Cth). The applicable GST amount will be shown at checkout.

The Company reserves the right to revise its prices at any time prior to accepting an Order. Once an Order has been accepted, the price will only be revised in the event of circumstances beyond Our reasonable control (such as significant changes to shipping costs, customs duties, or foreign exchange rates). In such cases, We will notify You promptly and You will have the right to cancel Your Order for a full refund.

Payments

All Goods are subject to a one-time payment at the time of purchase. Payment can be made through the payment methods available on the Service, which may include Visa, Mastercard, American Express, PayPal, and other methods as displayed at checkout.

Payment cards are subject to validation checks and authorisation by Your card issuer. If We do not receive the required authorisation, We will not be liable for any delay or non-delivery of Your Order.

Refunds

If You are not satisfied with Your order, You may return it (provided it is unused and in a resaleable condition) within 30 days of receipt by contacting Us with Your proof of purchase. We will be happy to offer an exchange or a refund using the original payment method.

If You paid by credit card or online payment service, please allow 5–7 working days for Your refund to be processed after We receive the returned Goods.

To return Goods by post, please send them back to Us within 30 days of receipt. Pack items securely in their original packaging and include Your proof of purchase and reason for return. We recommend using a tracked delivery service, as You are responsible for the Goods until they are received by Us.

Return Address:
PAi Industries Australia Pty Ltd
Mountain Creek, Queensland, Australia 4557

The cost of returning Goods is Your responsibility in the case of a change-of-mind return. Where Goods are faulty or misdescribed, We will cover reasonable return shipping costs in accordance with the Australian Consumer Law.

Please allow up to 14 working days for Your return to be processed once received by Us.

If there is a problem with the Goods You receive (other than a change of mind), please contact our customer service team.

5. User Accounts

When You create an account with Us, You must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms and may result in immediate termination of Your account.

You are responsible for safeguarding Your password and for all activities or actions taken under Your account. You agree not to disclose Your password to any third party and must notify Us immediately upon becoming aware of any unauthorised use of Your account.

You may not use a username that is the name of another person or entity, infringes the rights of another party, or is offensive, vulgar, or obscene.

6. Intellectual Property

The Service and its original content (excluding content provided by You or other users), features, and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark, and other applicable laws.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

7. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. We strongly advise You to read the terms and privacy policies of any third-party websites You visit.

8. Termination

We may terminate or suspend Your account immediately, without prior notice or liability, if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your account, You may simply discontinue using the Service or contact Us to request account deletion.

9. Limitation of Liability

To the maximum extent permitted by applicable law — and subject to Your rights under the Australian Consumer Law, which cannot be excluded, restricted, or modified — the Company’s total liability to You for any claim arising out of or relating to these Terms or the Service shall be limited to the amount actually paid by You for the Goods giving rise to the claim.

Where the Australian Consumer Law permits Us to limit Our liability for a failure to comply with a Consumer Guarantee in respect of goods that are not ordinarily acquired for personal, domestic, or household use, Our liability is limited (at Our option) to: the replacement of the Goods or supply of equivalent goods; the repair of the Goods; the payment of the cost of replacing the Goods or acquiring equivalent goods; or the payment of the cost of having the Goods repaired.

Subject to the same statutory rights, the Company shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or business interruption, arising out of or in connection with these Terms or Your use of the Service.

Nothing in these Terms limits or excludes Our liability for: (i) death or personal injury caused by Our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot be limited or excluded under Australian law.

10. Disclaimer

Subject to Your statutory rights under Australian law, the Service is provided “as is” and “as available” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no representations as to the accuracy or completeness of any information on the Service.

11. Governing Law and Disputes

These Terms are governed by the laws of Queensland, Australia. Any disputes arising under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Queensland.

If You have a concern or dispute about the Service, We encourage You to first contact Us directly so We can try to resolve the matter informally.

If a dispute cannot be resolved informally, You may also contact the Australian Competition and Consumer Commission (ACCC) or Your state or territory consumer protection agency for assistance.

12. Severability and Waiver

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any breach shall not constitute a waiver of any subsequent breach.

13. Changes to These Terms and Conditions

We reserve the right to modify or replace these Terms at any time at Our sole discretion. If a change is material, We will make reasonable efforts to provide at least 30 days’ notice before the new terms take effect.

By continuing to use Our Service after revisions become effective, You agree to be bound by the updated Terms. If You do not agree to the new Terms, please stop using the Service.
